This Cookie & Tracking Technologies Notice (the “Notice”) explains how SmartMorph AI, Inc. (“SmartMorph,” “BodiMorph,” “Company,” “we,” “us,” or “our”) may use cookies, pixels, tags, scripts, local storage, and similar technologies on the BodiMorph website.
This Notice should be read together with our Privacy Policy.
1. WHAT COOKIES AND TRACKING TECHNOLOGIES ARE
Cookies are small data files that may be stored on your browser or device when you visit a website.
Other technologies, including pixels, tags, scripts, local-storage technologies, software development tools, and similar identifiers, may perform related functions.
For simplicity, this Notice refers to these technologies collectively as “Cookies” or “Tracking Technologies.”
They may help websites:
- function properly;
- maintain security;
- remember preferences;
- understand traffic and usage;
- measure website performance;
- understand how visitors arrive at the website;
- measure advertising conversions;
- support attribution;
- prevent fraud; and
- support advertising or remarketing where permitted.
2. CATEGORIES OF TECHNOLOGIES WE MAY USE
Depending on the technologies actually deployed on the BodiMorph website, we may use the following categories.
A. Strictly Necessary Technologies
These technologies are used where reasonably necessary for functions such as:
- core website operation;
- security;
- fraud prevention;
- checkout functionality;
- session management;
- privacy-preference storage; and
- other functionality required for the website or services to operate.
Because these technologies may be necessary for requested services or essential website functionality, they may not always be subject to the same consent choices as optional technologies.
B. Analytics and Performance Technologies
These technologies may help us understand how visitors use BodiMorph, including:
- website traffic;
- pages viewed;
- visit duration;
- referral source;
- device and browser information;
- website performance;
- navigation patterns;
- button or link interactions; and
- other aggregated or usage-related information.
This information may help us improve website usability, content, performance, and customer journeys.
Technologies in this category may include services associated with providers such as Google Analytics or other analytics providers actually deployed by SmartMorph.
C. Advertising, Attribution, and Targeting Technologies
Where deployed and legally permitted, BodiMorph may use advertising or attribution technologies to:
- measure whether an advertisement led to a website visit;
- measure consultation bookings;
- measure Program purchases or conversions;
- understand advertising campaign performance;
- attribute traffic to marketing sources;
- create or measure advertising audiences;
- support retargeting or remarketing;
- limit or measure ad frequency; and
- improve advertising effectiveness.
Potential providers may include technologies associated with:
- Google Ads;
- Meta, including Facebook and Instagram;
- TikTok;
- Microsoft; and
- other appropriate advertising, attribution, or marketing providers.
Our legal-strategy decisions deliberately allow SmartMorph to use major advertising and analytics platforms as the business grows, while requiring the actual privacy controls to reflect what is genuinely installed rather than falsely claiming that every possible technology is active.
3. WE DO NOT CLAIM EVERY LISTED TECHNOLOGY IS CURRENTLY ACTIVE
This Notice describes categories of technologies SmartMorph may use.
A technology or provider listed in this Notice is not necessarily active on the BodiMorph website at every point in time.
SmartMorph may:
- add appropriate technologies;
- remove technologies;
- change providers;
- replace technologies; or
- modify configurations as our website, advertising strategy, technology stack, or legal obligations evolve.
Our goal is for the actual cookie-preference system to correspond with technologies actually deployed on the website.
4. COOKIE PREFERENCES
Where appropriate, BodiMorph will provide a Cookie Preferences control that allows visitors to manage applicable non-essential Tracking Technologies.
Depending on the technology and your jurisdiction, available choices may include categories such as:
Necessary
Technologies required for essential operation and security.
Analytics
Technologies used to understand website usage and performance.
Advertising / Targeting
Technologies used for advertising measurement, attribution, targeting, remarketing, or similar purposes.
Your available choices may differ depending on the technologies in use and applicable legal requirements.
The legal architecture specifically requires Cookie Preferences to function as an actual control—not merely a decorative footer link.
5. CONSENT
Where applicable law requires consent before certain non-essential Cookies or Tracking Technologies may operate, BodiMorph intends to request appropriate consent before activating those technologies.
Where consent is required, declining optional Cookies should not prevent use of core website functionality that does not depend on those optional technologies.
Some strictly necessary technologies may operate without optional consent where legally permitted because they are reasonably necessary to provide requested functionality, maintain security, preserve privacy choices, or operate the website.
6. WITHDRAWING OR CHANGING YOUR CHOICES
Where a Cookie Preferences mechanism is available, you may use it to review or change your applicable choices.
Changing your preferences may not automatically erase information previously processed lawfully before the change.
It may also take a short period for updated preferences to propagate through applicable systems.
7. BROWSER CONTROLS
Most browsers provide settings that allow users to:
- block certain cookies;
- delete cookies;
- limit cookie storage; or
- receive notifications when cookies are being used.
Disabling cookies at the browser level may affect website functionality.
Browser settings operate independently from BodiMorph’s own Cookie Preferences mechanism.
8. OPT-OUT PREFERENCE SIGNALS
Some jurisdictions require businesses to recognize qualifying browser or device-based privacy preference signals for certain activities.
Where applicable law requires SmartMorph to recognize a legally valid opt-out preference signal, SmartMorph intends to configure relevant systems to honor that signal as required.
Other browser “Do Not Track” signals may not have a uniform legal or technical standard and therefore may not receive identical treatment.
9. ADVERTISING AND PRIVACY CHOICES
Certain advertising technologies may involve the disclosure of identifiers or website-activity information to advertising partners.
Depending on applicable law, some of those practices may be legally described as:
- “sale” of personal information;
- “sharing” of personal information;
- targeted advertising;
- cross-context behavioral advertising; or
- similar regulated processing.
SmartMorph does not assume that using an advertising provider automatically means the Company “sells” information in every legal jurisdiction.
Instead, SmartMorph intends to evaluate its actual technologies and practices against applicable legal definitions.
Where a right to opt out applies, SmartMorph may provide a Your Privacy Choices, Do Not Sell or Share My Personal Information, or comparable legally appropriate mechanism.
10. PRIVATE COACHING INFORMATION IS SEPARATE
Advertising and website Tracking Technologies are intended to operate separately from private BodiMorph Founder’s Program coaching records.
SmartMorph does not intend to use advertising pixels or similar advertising technologies to sell or create advertising audiences from private Client coaching records such as:
- body weight;
- calorie logs;
- protein logs;
- private coaching communications;
- internal coaching notes;
- health limitations;
- medication disclosures; or
- other sensitive Founder’s Program information.
The Privacy Policy governs the separate handling of private coaching records.
11. THIRD-PARTY TECHNOLOGIES
Some Tracking Technologies are provided or operated by third parties.
Depending on the technology, those providers may process information such as:
- IP address;
- device identifiers;
- browser information;
- website interaction data;
- referral information;
- advertising identifiers;
- conversion events; or
- other information involved in their service.
Third-party providers may also maintain their own privacy policies and technology practices.
SmartMorph does not control every independent aspect of a third party’s systems simply because we use its technology.
12. ANALYTICS
Where enabled, analytics technologies may help SmartMorph understand matters such as:
- number of website visitors;
- how users navigate the website;
- commonly viewed pages;
- device and browser categories;
- traffic sources;
- geographic regions at an approximate level;
- website errors;
- site speed or performance; and
- conversion funnels.
Analytics information may be used to improve BodiMorph’s website, content, customer experience, and business operations.
13. CONVERSION MEASUREMENT
BodiMorph may use conversion-tracking technologies to understand whether advertising or marketing activity results in actions such as:
- website visits;
- video engagement;
- consultation bookings;
- waitlist signups;
- checkout visits;
- purchases; or
- other relevant conversion events.
This supports the acquisition and performance-tracking structure already contemplated in the BodiMorph operating model.
14. CAMPAIGN AND REFERRAL TRACKING
BodiMorph may use tracked links, campaign identifiers, referral parameters, or similar technologies to understand how people discover BodiMorph.
These may be associated with channels such as:
- Meetup workshops;
- paid advertising;
- direct referrals;
- social media;
- email campaigns;
- organic website visits; or
- other acquisition sources.
Tracking may help SmartMorph understand which campaigns, communities, or channels generate interest, consultations, or enrollments.
15. DATA RETENTION
Retention periods associated with Cookies and Tracking Technologies may vary by:
- technology;
- provider;
- configuration;
- business purpose;
- user choice; and
- applicable law.
Some Cookies may expire when the browser session ends.
Others may remain for a defined period unless removed sooner.
SmartMorph intends to configure technologies and retention periods reasonably in light of their purpose and applicable legal requirements.
16. SECURITY AND FRAUD PREVENTION
Tracking Technologies may also be used to:
- detect suspicious activity;
- protect checkout processes;
- protect website infrastructure;
- prevent abuse;
- maintain security;
- enforce privacy preferences; or
- prevent fraud.
These functions may be considered necessary or essential depending on the particular technology and context.
17. CROSS-BORDER PROCESSING
Third-party analytics, advertising, marketing, and technology providers may process information in countries different from the country in which you reside.
As described in our Privacy Policy, this means information may be processed in the United States, Canada, or other jurisdictions where SmartMorph or its service providers operate.
Applicable privacy protections and governmental-access rules may differ between jurisdictions.
18. CHILDREN
The BodiMorph Founder’s Program is available only to adults age 18 or older.
SmartMorph does not intentionally use Tracking Technologies to create advertising profiles based on private Founder’s Program information belonging to minors, and minors may not enroll in the Program.
19. CHANGES TO THIS NOTICE
SmartMorph may update this Cookie & Tracking Technologies Notice as:
- technologies change;
- providers change;
- new tools are implemented;
- existing tools are removed;
- business practices evolve; or
- legal requirements change.
When updated, the Effective Date may be revised.
The Cookie Preferences interface, where available, may provide more current information concerning categories of technologies actually deployed at a particular time.
